These Terms of Service ("Terms") govern your use of the software products and services ("Services") provided by HearthSoft LLC ("HearthSoft," "we," "us," or "our"). By accessing or using our Services, you agree to be bound by these Terms.

1. Use of Services

You may use our Services only in compliance with these Terms and all applicable laws. You must be at least 18 years of age to use our Services. You are responsible for maintaining the security of your account credentials.

2. Subscriptions and Billing

Our Services are offered on a subscription basis. By subscribing, you authorize us to charge the applicable fees to your designated payment method on a recurring basis. Subscription fees are billed in advance for each billing period.

3. Cancellation and Refunds

You may cancel your subscription at any time. Cancellation takes effect at the end of your current billing period. No refunds are provided for the current billing period. After cancellation, you will continue to have access to the Services until the end of your paid billing period.

4. Intellectual Property

All content, features, and functionality of our Services are owned by HearthSoft LLC and are protected by applicable intellectual property laws. You retain ownership of any data you upload to our Services.

5. Disclaimer of Warranties

OUR SERVICES ARE PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, WHETHER EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT. We do not warrant that the Services will be uninterrupted, error-free, or secure.

6. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, HEARTHSOFT LLC SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR ANY LOSS OF PROFITS OR REVENUES, WHETHER INCURRED DIRECTLY OR INDIRECTLY, OR ANY LOSS OF DATA, USE, GOODWILL, OR OTHER INTANGIBLE LOSSES RESULTING FROM YOUR USE OF THE SERVICES. Our total liability for any claims under these Terms shall not exceed the amount you paid us in the twelve (12) months preceding the claim.

7. Modifications

We may update these Terms from time to time. We will notify you of material changes by posting the updated Terms on our website with a revised "Last updated" date. Continued use of the Services after changes constitutes acceptance of the updated Terms.

8. Termination

We may suspend or terminate your access to the Services at any time for any reason, including violation of these Terms. Upon termination, your right to use the Services ceases immediately.

9. Governing Law

These Terms are governed by the laws of the State of Alabama, United States, without regard to conflict of law principles. Any disputes arising under these Terms shall be resolved in the courts located in the State of Alabama.
